  • 1GuyGadget – TERMS OF USE AND SERVICE

    The Terms and Conditions detailed below establish a legally binding agreement between 1GuyGadget and you, the Client, regarding the submission and payment for electronic device(s). These terms also extend to future communications, updates, pricing adjustments, and services provided unless explicitly stated otherwise.

  • Before engaging in any transactions with us, please review these Terms and Conditions. By completing a trade-in request, submitting your device(s), or accepting payment from 1GuyGadget, you acknowledge and consent to these terms. If you do not accept these terms, DO NOT complete a trade-in quote request or send your device(s), as doing so constitutes your legal agreement to this contract.

  • To conduct business with us, you must provide accurate and current information that complies with applicable laws and regulations governing this binding agreement.

  • 1GuyGadget.com is owned and operated by 1GuyGadget. We do not have any affiliation, endorsement, or sponsorship with brands, manufacturers, or companies mentioned on our website. All trademarks, copyrights, logos, and likenesses remain the property of their respective owners unless otherwise specified.


  • YOUR PRIVACY

    At 1GuyGadget, we are committed to protecting your privacy as part of maintaining a long-term relationship. The personal information you provide (email, address, phone number, etc.) will be used solely for processing your transactions with us. We will not share or sell your information to any third parties under any circumstances.

  • You are responsible for deleting all personal data from your device(s) before sending them to us. While we will attempt to wipe any remaining data, we do not guarantee data removal. By sending your device(s), you release us from any liability related to data security, integrity, or loss. Should you have concerns, please contact us at cure@1guygadget.com.


  • PRICING AND OFFER ADJUSTMENTS

    Our goal is to provide a simple and transparent trade-in process. Most of the time, you will receive the quoted payment. However, in certain cases—including discrepancies in model, storage capacity, condition, or features—your offer may be subject to revision. Any revisions may increase or decrease your initial offer.

    To ensure accuracy, please describe your device(s) truthfully based on our website guidelines. If the condition is grossly misrepresented, or your device(s) show signs of tampering (such as broken manufacturer seals or unauthorized repairs), we will adjust the offer accordingly.

    Should your offer change, you will have SEVEN days to accept or decline. If no response is received, payment will be issued automatically under the revised amount using the originally selected payment method.

    All trade-in offers remain valid for TWENTY-ONE days. If we do not receive your device(s) within this timeframe, your quote will be re-evaluated based on current market conditions. We reserve the sole right to cancel an offer at any time without prior notice.


  • TRADE-IN PROCESS

    • Offer: Your trade-in quote remains valid for TWENTY-ONE days. All contact information you provide must be accurate and valid. Incorrect details may delay processing or result in cancellation.

    • Shipping: We recommend recording video evidence showing the IMEI/Serial Number along with the device’s condition within 36 hours prior to shipping.

    • Tracking: You can monitor your device(s) status via your 1GuyGadget account or our tracking system.

    • Testing: Devices are typically inspected within 48 hours after arrival. If accessories are missing, testing may take up to an additional five business days.

    • Payments: Once assessment is complete, payment will be sent through your selected method, or a revised offer will be issued.

    • Larger Payments: Transactions over $1,100 require an additional two to three business days for processing.


  • RETURNS AND MISREPRESENTATION

    We strive to purchase all submitted devices, but some circumstances require a return. If a return is necessary due to our error, 1GuyGadget will cover the return shipping cost.

    However, gross misrepresentation, activation/iCloud locks, or financial liens on a device disqualify it from free returns. If your device is deemed valueless and you do not decline the revised offer within SEVEN days or fund the return shipment, we will recycle the device.

    If a grossly misrepresented device remains unclaimed for more than 30 business days, it will be surrendered to the BUDA TEXAS POLICE DEPARTMENT.

    During inspections, protective casings may need removal. If a return is requested mid-process, we will attempt to send the device back in its original condition but make no guarantees.

    Free return shipping does not apply if:
    • The device was significantly misrepresented.
    • The device was reported stolen.
    • The device was locked to an account and the client rejects the revised offer.
    • The device is still under a financial contract, and the client refuses the revised offer.


  • TRANSFER OF OWNERSHIP

    Upon receipt of payment from 1GuyGadget, full ownership rights, title, and interest in the device(s) irrevocably transfer to 1GuyGadget. The device(s) cannot be reported as lost or stolen or included in any insurance claims after ownership is transferred. Any attempt to do so constitutes insurance fraud, a criminal offense punishable under applicable law. 1GuyGadget reserves the right to pursue legal action to the fullest extent permitted.


  • ABUSE

    While we understand that accurately assessing your device’s condition can be challenging, we encourage you to contact us with any questions before submitting your trade-in request. We strive to uphold fairness in evaluations and limit unnecessary offer adjustments to foster trust in the 1GuyGadget brand.

    However, gross misrepresentation or major discrepancies are considered abuse of our system and are not eligible for free return shipping when an adjusted offer is declined. 1GuyGadget reserves the sole right to determine whether its system has been abused. Any deliberate misrepresentation may result in additional fees, delayed processing, or offer cancellation. Clients responsible for abuse must cover the cost of return shipping and any expenses incurred by 1GuyGadget through the use of prepaid shipping labels.


  • LOST OR DAMAGED PACKAGE

    If your device(s) are lost or damaged during transit, 1GuyGadget will work with you to find an appropriate resolution. Most shipments are insured by the carrier up to a base amount, but we strongly recommend purchasing additional insurance if the value of your device(s) exceeds this amount. 1GuyGadget cannot assist with claims for devices exceeding the insured value if additional coverage was not purchased.

    We are not responsible for missing shipments that were not scanned at the drop-off point. Additionally, we are not liable for damages caused by improper packaging, such as using thin, unpadded envelopes or unsealed boxes. Items packaged inadequately will not be reimbursed. If unsure about packaging requirements, please consult a courier representative before shipping.


  • All outgoing shipments from 1GuyGadget are insured based on the value we assess. If a revised offer was issued, the insured value will match the new offer, regardless of your acceptance. To file a claim, you must provide proof of purchase and comply with all insurance requirements.


  • CUSTOMER REPRESENTATION

    By entering into a trade-in agreement, you certify that you are at least 18 years old and the sole lawful owner of the submitted device(s). No other individual, entity, or organization holds any claims or rights to the device(s). You also confirm that the device(s) are not stolen, counterfeit, or fraudulent.

    1GuyGadget enforces a zero-tolerance policy for stolen, fake, or counterfeit devices. Any such items will be turned over to federal authorities and will not be returned under any circumstances, as mailing fraudulent items constitutes mail fraud. If uncertain about your device’s legitimacy, contact us before sending it. We reserve the right to withhold or report any item suspected to be obtained through fraudulent means. Return shipments, if applicable, will only be made to the original verified sender address.



  • REFERRALS

    1GuyGadget strives to build lasting relationships by offering referral incentives. Referral amounts will be determined and distributed on a monthly basis at 1GuyGadget’s discretion. We reserve the right to modify or discontinue referral payments at any time.


  • TRADEMARKS

    All content on 1GuyGadget.com—including images, text, and code—is the sole property of 1GuyGadget and is protected under trademark laws. Unauthorized use, duplication, or distribution is strictly prohibited without prior written consent from 1GuyGadget.


  • MISCELLANEOUS

    To avoid processing delays, ensure all required documentation, return labels, and receipts are included with your shipment. If additional information is needed for a return, we will contact you, and the speed of your response will determine how quickly your device(s) are returned.

    If a device’s make or model was misrepresented, knowingly or unknowingly, 1GuyGadget will update the listing based on our assessment, inform you of the findings, and adjust payment accordingly.

    To prevent complications, accurately describe your device(s) and verify all specifications before shipping.


  • LEGAL DISPUTES

    All legal disputes arising from transactions with 1GuyGadget will be resolved through arbitration, without attorney involvement.
